Acceptance of Terms

Please read these Terms & Conditions carefully.

These Terms & Conditions apply to Your use of TAP&REUSE™ and the Returnable Packaging and are made between You and Kleen Hub ApS By tapping Your payment method on the TAP&REUSE™ Payment Card Terminal, You agree to be bound by these Terms & Conditions.

Introduction

You are about to borrow some Returnable Packaging for the food or drink item You purchase. The Returnable Packaging is designed to be used by You and then returned to a Collection Point so it can be washed and used again. The Returnable Packaging is not to be used for any other purpose.

Returnable Packaging is an alternative to single-use which this Retailer is working hard to reduce. You get to borrow Returnable Packaging, use it and then give it back - all at no cost to you.

The Returnable Packaging is food safe and will withstand commercial use, and washing.

The Returnable Packaging provided with TAP&REUSE™ is free for the User; charges only apply if the Returnable Packaging is not returned to a Collection Point before the end of the Return Period.

You do not need to download an app and You do not need to register anywhere. TAP&REUSE™ really is designed to be that simple.

How it works

Order and pay for Your food or drink at the till as normal. The barista/server will also scan the Returnable Packaging for You.

You will receive Your food/drink in an item of Returnable Packaging. You borrow the Returnable Packaging by tapping your payment method on the TAP&REUSE™ Payment Card Terminal. That Returnable Packaging is now linked to Your payment method, and You will receive your food or drink in it. A Pending Transaction of 1p is authorised by tapping Your payment method and will be live on Your bank account whilst You borrow the Returnable Packaging.

Enjoy Your meal or drink. When You are finished, return the Returnable Packaging to the nearest Collection Point for that Retailer. This will usually be in the shop/café/venue/event from where You borrowed the Returnable Packaging, but for multi-venue Retailers, there may be other Collection Points available.

Return the Returnable Packaging to the Collection Point within the Return Period. Once returned, the Pending Transaction is cancelled, and You have borrowed and returned Your Returnable Packaging at no cost to you. (it will usually take around 48 hours for the Pending Transaction to clear from Your bank account/statement, however, depending on the particular bank, this may take a little longer).

If You do not return the Returnable Packaging to the Collection Point within the Return Period, You have Failed to Return and a vatable sale has occurred. The Failed to Return Payment will be applied to Your original payment method and that Returnable Packaging is now Yours; You are no longer able to return it.

Definitions and Information

Kleen Hub ApS (trading as kleen hub) and we design and manufacture the Returnable Packaging. We have provided these items to the Retailer to bring You the smart, sustainable technology behind TAP&REUSE™.

Collection Point this is a collection bin or area that is an appropriate place for You to return the Returnable Packaging to the Retailer by the end of the Return Period. The best way to return the Returnable Packaging is by handing it back to the barista/server or by placing it in the Collection Point in the venue/cafe You originally visited. Please ask the barista/server for your nearest Collection Point.

Collection Point Map if the Retailer has multiple Collection Points at different venues and if available, by scanning the QR code on the Returnable Packaging, a map will show You the nearest Collection Point for that Retailer. The best way to return the Returnable Packaging is by handing it back to the barista/server or by placing it in the Collection Point in the venue/cafe You originally visited.

Failed to Return this occurs when the User does not return the Returnable Packaging to an appropriate Collection Point before the end of the Return Period.

Failed to Return A payment for the unreturned packaging (variable price, exact price presente in POS printed material) will be debited from the debit or credit card that You used when You tapped your payment method on the TAP&REUSE™ Payment Card Terminal. The Failed to Return Payment will only be debited from Your account if You have Failed to Return the Returnable Packaging within the Return Period. This is a vatable sale and once payment has been made by You, You are no longer able to return your Returnable Packaging.

Pending Transaction this is a 0 value transaction sent to the card issuer to ensure Your payment card is working and to enable you to borrow the Returnable Packaging. If You return the Returnable Packaging within the Return Period to an appropriate Collection Point, the Pending Transaction will be removed from Your bank account (it will usually take around 48 hours for the Pending Transaction to clear from Your bank account/statement, however, depending on the particular bank, this may take a little longer).

Retailer the venue that You visit to purchase food or drink supplied to You in Returnable Packaging.

Return Period this is 7 days from the date You tapped your payment method on the TAP&REUSE™ Payment Card Terminal to reserve the Returnable Packaging.

Returnable Packaging this is the returnable item in which You receive Your food or drink item. It is a sustainable, reusable piece of packaging from which to enjoy Your meal or drink, and is then to be returned by You to a Collection Point. The Returnable Packaging could be a returnable coffee cup or soft drink cup, a snack box, a takeaway food container or anything else available through TAP&REUSE™.

TAP&REUSE™ is a trademarked Returnable Packaging borrowing platform aimed at reducing packaging waste for to-go consumption or food/drink delivery.

TAP&REUSE™ Payment Card Terminal this is the small point of sale reader that the barista/server will present to You and on which You will tap your payment method to borrow the Returnable Packaging and to link it to You.

Terms & Conditions means these general terms and conditions. By tapping Your payment method on the TAP&REUSE™ Payment Card Terminal You accept these Terms & Conditions and agree to be bound by them.

User/You/Your means You, the person tapping Your card on the TAP&REUSE™ Payment Card Terminal and purchasing food or drink in Returnable Packaging.

Please read these General Terms & Conditions carefully. By tapping Your card on the TAP&REUSE™ Payment Card Terminal, You agree to be bound by these Terms & Conditions.

Further Information

You can tap the TAP&REUSE™ Payment Card Terminal more than once to reserve more than one item of Returnable Packaging – so if You want to buy Your friends a drink or some food, You can! Just let the barista/server know and they will scan more than one item of Returnable Packaging to Your payment card – You will need to tap Your payment method each time. You remain responsible for any Returnable Packaging that You borrow for someone else’s use.

The Legal Info

Eligibility – You must be at least 18 years old and have legal capacity to participate in TAP&REUSE™.

Validity – You must have a valid debit or credit card with sufficient funds to cover the Failed to Return Payment at the time You tap Your payment method on the TAP&REUSE™ Payment Card Terminal.

Authorisation – By using TAP&REUSE™ you authorise kleen hub to charge Your payment method with the Failed to Return Payment without further notice to You if You have Failed to Return the Returnable Packaging within the Return Period.

Delay - Kleen hub and/or the Retailer are not responsible for a delay that You encounter in returning the Returnable Packaging to a Collection Point. You must check the opening hours of the Retailer and/or the availability of a Collection Point to ensure you can return the Returnable Packaging within the Return Period.

Expiry - If You return Your Returnable Packaging after the Return Period has expired you will still be charged the Failed to Return Payment even if you have since returned the Returnable Packaging.

Use - You agree to use the Returnable Packaging provided through TAP&REUSE™ for its intended purpose and in accordance with any instructions provided by the Retailer.

Dispute - In the event of a dispute or disagreement over the Failed to Return Payment, please contact hello@kleenhub.com for further information and how to make an inquiry.

IP – All content, trademarks and other intellectual property remains the property of kleen hub as owner or licensee. You may not reproduce, distribute, modify or create derivative works from our content or products without kleen hub's prior written consent.

Termination – Kleen hub reserves the right to terminate or suspend Your access to TAP&REUSE™ without prior notice or liability for any reason, including without limitation, if You breach these Terms and Conditions.

Liability –Kleen hub its directors, employees, partners, agents, suppliers, or affiliates will not be liable for any losses that are:

Unexpected. It was not obvious that it would happen and nothing You said before Your order was accepted meant we should have expected it (so, in the law, the loss was unforeseeable).
Caused by a delaying event outside our control. We're not responsible for delays outside our control.
Avoidable. Something You could have avoided by taking reasonable action. For example, damage to Your property through incorrect use of the Returnable Packaging.
A business loss. It relates to Your use of a product for the purposes of Your trade, business, craft or profession.

Data Protection – All personal information will be processed and held in accordance with the provisions of EU Regulation 2016/679 General Data Protection Regulation (“GDPR”) and Your rights under the GDPR.

Marketing – we will not use Your details for marketing purposes without Your prior consent.

General – These Terms and Conditions are between You and us and may not be transferred to any other person. Nobody else can enforce them and neither of us will need to ask anybody else to sign-off on ending or changing them. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply. We might not immediately chase You for not doing something (like paying) or for doing something You're not allowed to, but that doesn’t mean we can't do it later.

Law & Jurisdiction - These Terms and Conditions (including any non-contractual matters and obligations arising from or associated with) will be governed by, and construed in accordance with, the laws of England and Wales and any dispute will be based within the laws & jurisdiction of England and Wales.

Circular we are ashortwalk Limited (trading as Circular&Co.) and we design and manufacture the Returnable Packaging. We have provided these items to the Retailer. We have partnered with Kleen Hub ApS to bring You the smart, sustainable technology behind TAP&REUSE™.

Failed to Return this occurs when the User does not return the Returnable Packaging to an appropriate Collection Point before the end of the Return Period.

Failed to Return Payment this is £3 and will be debited from the debit or credit card that You used when You tapped your payment method on the TAP&REUSE™ Payment Card Terminal. The Failed to Return Payment will only be debited from Your account if You have Failed to Return the Returnable Packaging within the Return Period. This is a vatable sale and once payment has been made by You, You are no longer able to return your Returnable Packaging.

Pending Transaction this is a reservation of 1p by Your card issuer to ensure Your payment card is working and to enable you to borrow the Returnable Packaging. If You return the Returnable Packaging within the Return Period to an appropriate Collection Point, the Pending Transaction will be removed from Your bank account (it will usually take around 48 hours for the Pending Transaction to clear from Your bank account/statement, however, depending on the particular bank, this may take a little longer).

Retailer the venue that You visit to purchase food or drink supplied to You in Returnable Packaging.

Return Period this is 7 days from the date You tapped your payment method on the TAP&REUSE™ Payment Card Terminal to reserve the Returnable Packaging.
